What are Ohio’s rules for transferring vehicles after death?

When someone dies, ownership of a car or truck does not transfer automatically. Ohio law sets specific rules for how motor vehicles pass to family members or other beneficiaries after death. Understanding these rules helps reduce delays, paperwork issues, and stress during an already difficult time.

How vehicle ownership transfers through probate

If the deceased owned the vehicle in their name alone and did not use a planning tool, the transfer usually occurs through probate. The probate court authorizes an executor or administrator to sign documents that transfer the title to an heir or allow a sale. Until that authority is granted, the vehicle often cannot be legally transferred, which can delay use, sale, or insurance changes.

Using a transfer on death vehicle title

Ohio allows a transfer on death designation for motor vehicle titles under Ohio Revised Code § 2131.13. This option lets you name a beneficiary who receives the vehicle at death without probate. After death, the beneficiary presents the title, a certified death certificate, and proper identification at the county title office to place the vehicle in their name.

Joint ownership and survivorship rights

Ohio also recognizes survivorship vehicle ownership under Ohio Revised Code § 2131.12. When a title reflects survivorship ownership, the surviving owner becomes the sole owner after death without probate. Simply listing two names on a title does not guarantee this result, since survivorship must be properly established under the statute.

Small estates and simplified options

Ohio law offers simplified probate procedures for smaller estates, including release from administration and summary release from administration under Ohio Revised Code §§ 2113.03 and 2113.031. These options may apply when the estate value falls below statutory limits and can allow vehicle transfers with fewer court steps. Proper forms and supporting documentation are still required before the title changes.
