Complying with Ohio’s Sunshine Laws

Ohio’s Sunshine Laws are designed to facilitate government transparency and accountability. They give citizens the right to know how public business is conducted, creating a framework for openness that applies to both public records and public meetings. 

For municipalities, complying with these laws is not only a legal requirement but also a way to build trust with the communities they serve. Failing to comply can result in legal consequences and damage to public confidence.

What compliance entails, in practical terms 

The public records portion of the Sunshine Laws requires that records kept by public offices be made available for inspection and copying upon request, unless a specific exemption applies. This includes documents, emails and other materials created or maintained in the course of official duties. Municipalities must respond to requests promptly and cannot unreasonably delay or deny access. 

The open meetings requirement is another compliance consideration that must be addressed effectively. Meetings of public bodies, such as city councils, planning commissions and school boards, must be open to the public unless a narrow exception allows for an executive session.
